Nexorion Terms of Service

These Terms are the agreement between you and Nexorion, an independent game made in Türkiye — "we", "us" — for playing Nexorion. They work as the game's end-user licence agreement (EULA). Please read them; the game asks you to accept them before you play, and asks again whenever they change.

Two other documents are part of this agreement:

• the Privacy Policy — what data we collect and why;
• the Community Rules — how to behave in the game.

If you do not agree, do not play.

1. Who can play

1.1 You must be at least 13 years old. Children under 13 may not play or create an account.

1.2 If you are under 18 (or under the age of majority where you live, if it is different), a parent or guardian must read and agree to these Terms for you. When the game asks, they must confirm that they agree. By confirming, the parent or guardian accepts these Terms on your behalf and is responsible for your use of the game, including what you do in it.

1.3 You must answer the age question truthfully. If we learn that a player is under 13, or that a younger player plays without a parent's or guardian's agreement, we may close the account.

1.4 You may not play if we have banned you, or if the law where you live forbids it.

2. Your account

2.1 You sign in with Steam on a computer, or with Sign in with Apple on an iPhone. You need a Steam account or an Apple ID in good standing, and the Steam Subscriber Agreement or Apple's terms also apply to you. One Steam account has one Nexorion account, and so does one Apple ID. You can link your Steam account and your Apple ID to play one account on both; if each already has an account, you choose which one to keep, and the other is deleted as described in 11.1.

2.2 You choose an account name the first time you sign in. It is shown to everyone, so it must follow the Community Rules (no offensive names, no impersonation). We may change or remove names that break the rules.

2.3 Your account is personal. Do not sell, buy, lend, share or give away accounts, and do not let other people play on yours. You are responsible for what happens on your account. Keep your Steam account and Apple ID secure; if you think someone else has accessed it, tell us at support@nex-orion.com.

3. Your licence to play

3.1 Nexorion is licensed, not sold. We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game for your own non-commercial entertainment, as long as you follow these Terms. All rights in the game — code, art, music, text, the game world, its items and characters — belong to us or our licensors.

3.2 Unless the law clearly allows it, you may not:

• copy, modify, translate (other than through our volunteer translation programme), decompile, disassemble or reverse-engineer the game or its network protocol;
• use or make cheats, hacks, bots, macros, automation, modified clients, packet editors, memory editors or any tool that gives an unfair advantage or plays for you;
• interfere with or attack our servers, other players' connections or Easy Anti-Cheat (for example denial-of-service attacks or bypassing anti-cheat);
• run or connect to unofficial or private servers that use our game or its content;
• use the game or its content commercially (for example selling services, items or accounts) without our written permission.

3.3 Videos, streams and screenshots of the game are welcome, including monetised ones, as long as they do not suggest we endorse you and do not break the Community Rules.

4. Gems, items and other virtual things

4.1 The game has virtual items and currencies, such as gems, circus coins, World Locks and other locks, blocks, seeds, clothing and other items ("Virtual Items"). Virtual Items:

• are part of the licence in section 3 — you do not own them and they are not property;
• have no real-world monetary value and cannot be exchanged for real money, goods or services from us;
• may be changed, rebalanced, renamed or removed by us as the game develops, including for game balance or to fix bugs.

4.2 No real-money purchases. At the moment you cannot buy gems or any other Virtual Item from us with real money. Gems are earned by playing. If we ever add purchases, we will update these Terms first and you will be asked to accept them.

4.3 Trading in the game with other players is allowed through the game's own features (trade window, vending machines, donation boxes and similar). Trades are between players and are final. Be careful: we generally cannot restore items lost through voluntary trades, scams, giving your items away or sharing your account, although we may help in serious cases at our discretion.

4.4 Real-money trading is forbidden. You may not buy, sell or offer Virtual Items, gems, worlds or accounts for real money or anything of real-world value outside the official Steam features described in 4.5 — for example on websites, marketplaces, Discord servers or through direct payments. This includes "boosting" services.

4.5 Steam Inventory items. Some items (currently only Leaf Wings) can be moved from the game to your Steam inventory:

• Moving an item is a request, not a right. It needs our approval after a background check, and you must meet the conditions shown in the game (for example level, play time, Steam account age, no bans, a monthly limit). We may refuse a request; if we do, the item returns to your bag.
• Once an item is in your Steam inventory, the Steam Subscriber Agreement and Valve's rules apply to it. Steam may allow you to trade it with other Steam users or list it on the Steam Community Market. Any such trade or sale is between you, the other Steam user and Valve. We do not set prices, do not buy items back, and do not promise that any item will keep any value or remain tradable or marketable.
• Items in your Steam inventory can be brought back into the game where the game offers it.
• If an item reached Steam through a bug, cheating, fraud or a breach of these Terms, we may refuse future transfers, remove the matching items in the game, report the case to Valve and take action under section 7.
• Selling items on the Steam Community Market for Steam Wallet funds is not "real-money trading" under 4.4, as long as you use only Steam's own features.

4.6 Playtest and early access. Nexorion is still in development. While it is in a Steam Playtest or early-access phase, progress, items, worlds and accounts may be reset (for example when the game moves from the Playtest to the full release), and features may change or disappear. We will try to warn players in advance.

5. What you create and say

5.1 Your content. Worlds you build, text on signs and boards, world and guild names and statements, chat messages and anything else you create or post in the game are "User Content". You keep whatever rights you have in your User Content.

5.2 Licence to us. So that we can run the game, you give us a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, copy, show, change (for example to fit the game or remove rule-breaking parts), and distribute your User Content in and around the game — including in trailers, screenshots, store pages and social media about Nexorion. This licence lasts as long as the content is in the game or in materials we already made, and after that for backups we are still allowed to keep. Worlds are shared spaces where other players also build, so a world can stay in the game after you leave it or delete your account.

5.3 Rules for User Content. You are responsible for your User Content. It must follow the Community Rules and the law. It must not contain other people's personal information, hate, harassment, sexual content, threats, spam, advertising, scams, links to cheats or malware, or material you do not have the right to use.

5.4 We may remove any User Content, world name or account name that breaks these Terms or the Community Rules, or that we are required to remove by law, without notice. We do not check everything in advance, and we are not responsible for User Content made by other players. If you see something illegal or harmful, tell us at support@nex-orion.com.

5.5 Chat is public. There are no private messages in Nexorion. What you say in a world is seen by everyone there and is written to our server logs (see the Privacy Policy).

6. Behaviour

You must follow the Community Rules. In short: be respectful; no harassment, hate, threats or sexual content; no cheating, bots, exploits or modified clients; no real-money trading; no scamming; no impersonation of other players, staff or us; no sharing of personal information; no spam or advertising. If you find a bug or exploit, report it to support@nex-orion.com instead of using it.

7. Moderation, anti-cheat and bans

7.1 World owners can moderate their own worlds (pull, kick and ban players from that world). This is part of the game, and we do not review every world owner's decision.

7.2 Our staff may warn you, kick you, remove content, reset or remove Virtual Items gained through cheating or bugs, or ban your account. Bans can be temporary (for example 30 minutes, 12 hours, 7 days) or permanent. When we ban you, the game tells you the reason.

7.3 Steam game bans for cheating. If you cheat, we may also ask Steam to apply a game ban to your Steam account for Nexorion. A permanent game ban is shown on your Steam profile. We only use Steam game bans for cheating.

7.4 Automatic protection. Our server checks every movement and can refuse impossible moves or disconnect you. Easy Anti-Cheat can remove you from a session. These automatic actions are disconnections, not bans; bans are always decided by a person.

7.5 Appeals. If you think a ban or action was a mistake, write to support@nex-orion.com with your account name. A person will review it. We may lift or shorten bans, but are not required to explain every detail of how we detect cheating.

7.6 Ban evasion (for example playing through someone else's account) is not allowed and can make a ban permanent.

8. Easy Anti-Cheat

8.1 Nexorion uses Easy Anti-Cheat, a service of Epic Games, Inc., to protect the game. By installing and playing Nexorion, you agree that Easy Anti-Cheat is installed and runs while you play. On Windows it uses a system service installed with the game.

8.2 Easy Anti-Cheat examines the game and your computer (for example running programs, memory, and files related to the game) to detect cheats, and shares results with Epic and with us. Details are in the Privacy Policy, section 3.8, and in Epic's privacy policy.

8.3 If Easy Anti-Cheat is not running, is blocked or is tampered with, you may not be able to play online. You can uninstall Easy Anti-Cheat by uninstalling the game (and, on Windows, through its own uninstaller).

9. Other services

You play through Steam and may use Discord features; Easy Anti-Cheat comes from Epic Games. These services have their own terms and privacy policies, and we are not responsible for them. If Steam, Discord or Epic stop working or change, parts of Nexorion may stop working too.

10. Changes to the game and availability

10.1 We continuously work on Nexorion. We may add, change or remove features, content and Virtual Items, and change game balance.

10.2 We try to keep the servers online, but we do not promise that the game will always be available or free of bugs. We may take it offline for maintenance, updates or security, and an older version of the game may need to be updated to keep playing.

10.3 We may stop running Nexorion altogether. If we decide to shut down the online service permanently, we will try to give at least 30 days' notice in the game, on nex-orion.com or on Steam.

11. Ending this agreement

11.1 You can stop playing at any time. You can delete your account in the game (Settings → Account → Delete account) or ask us to at privacy@nex-orion.com. A deleted account closes at once and is erased within 30 days; if it signs in with Apple, Nexorion is also removed from your Apple ID.

11.2 We may suspend or end your account and licence if you seriously or repeatedly break these Terms or the Community Rules, if the law requires it, or if your account puts other players or the game at risk. Where reasonable, we tell you why.

11.3 When this agreement ends, your licence ends, and you lose access to your account and Virtual Items in the game. Because Virtual Items have no monetary value and are not bought from us, no refund or compensation is due for them, except where the law requires it. Items already in your Steam inventory are governed by Steam's terms. Sections that by their nature should continue (for example 4.1, 5.2, 12, 13 and 14) continue to apply.

12. Disclaimer

The game is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these Terms — for example that the game will be uninterrupted, error-free, or suitable for a particular purpose — and we are not responsible for other players' behaviour or content.

This does not limit your statutory rights as a consumer (for example, legal guarantees for digital content under the law of the country where you live), which cannot be excluded by contract.

13. Limitation of liability

13.1 Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, for intent or gross negligence, or under mandatory consumer-protection or product-liability laws.

13.2 Subject to 13.1, and to the extent the law allows, we are not liable for:

• loss of Virtual Items, progress or worlds (including through resets during the Playtest or early access, bugs, or other players' actions);
• loss of profit, data or opportunity, or indirect or consequential damage;
• problems caused by Steam, Discord, Epic, your internet connection, your device or third-party software.

13.3 Subject to 13.1, and to the extent the law allows, our total liability to you for all claims relating to the game is limited to the greater of (a) what you paid for Nexorion in the 12 months before the claim and (b) EUR 50 (or its equivalent in your currency).

13.4 If you live in the EU or UK: we are liable under the law for foreseeable damage caused by our breach of these Terms or our negligence; "foreseeable" means it was an obvious consequence or both of us knew it might happen when you accepted these Terms. We are not liable for damage that was not foreseeable. The limits in 13.2 and 13.3 apply only as far as your local law permits.

14. Governing law and disputes

14.1 These Terms are governed by the laws of the Republic of Türkiye, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

14.2 The courts and enforcement offices of Türkiye have jurisdiction, subject to 14.3–14.5.

14.3 Consumers in Türkiye may also apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts (Tüketici Mahkemeleri) of their own place of residence, within the limits set by Law No. 6502 on Consumer Protection.

14.4 Consumers in the EU, EEA or UK: the choice of Turkish law does not take away the protection of the mandatory consumer laws of the country where you live. You may bring proceedings in the courts of the country where you live, and we may only bring proceedings against you there.

14.5 Consumers elsewhere keep any mandatory rights given to them by the law of their country of residence.

14.6 Before going to court, please write to support@nex-orion.com — most problems can be solved quickly.

15. Changes to these Terms

15.1 Each version of these Terms has a number. When we make a change that matters, we raise the number and the game asks you to read and accept the new version the next time you sign in. If you are under the age of majority, your parent or guardian must agree again.

15.2 If you do not accept the new version, you cannot continue to play, and you can ask us to delete your account.

15.3 We may correct typos or improve wording without a new version, as long as the meaning does not change.

16. General

16.1 These Terms, the Privacy Policy and the Community Rules are the whole agreement between you and us about Nexorion.

16.2 If a court finds part of these Terms invalid, the rest stays in force.

16.3 If we do not enforce a right immediately, we have not given it up.

16.4 You may not transfer your rights under these Terms. We may transfer this agreement to someone who takes over Nexorion (for example a publisher or a company we set up), provided your rights are not reduced; we will tell you if this happens.

16.5 These Terms are available in English and Turkish. For players in Türkiye, the Turkish version prevails if the two differ; for everyone else, the English version prevails, unless your local law requires otherwise.
